There are life circumstances where parents and children may go for long periods of time without contact. These circumstances come about due to issues including incarceration, domestic violence, substance use, alcohol use, and/or parental relocation. Parents of these circumstances often end up in situations which remove them from their child’s life for several months or years. Once the struggling parent overcomes their life challenges and improves their life circumstances, they often find they have lost custody to the other parent or a grandparent of their child(ren).
When the relationship between parent and child needs to be repaired it can be difficult to begin the process of reunification, especially if the other parent does not agree to it. It is the court’s view that it is in the best interest of every child to have a relationship with both of their parents. Parental rights are recognized by the court as being constitutional rights which means a parent does not automatically lose their rights as a parent without due process and a court hearing. However, a parent does not want to wait until they are served with papers to assert their parental rights as that point may be too late.
